What is a 501(c) organization?
A 501(c)(3) is an organization recognised by the IRS as exempt under that paragraph of the Internal Revenue Code: organized and operated exclusively for exempt purposes, with no earnings inuring to a private shareholder or individual, no substantial lobbying and no political campaign activity (IRS). Not every nonprofit is a 501(c)(3).

What does the IRS require of a 501(c)(3)?
- Organized and operated exclusively for exempt purposes set out in section 501(c)(3).
- None of its earnings may inure to any private shareholder or individual.
- It may not attempt to influence legislation as a substantial part of its activities.
- It may not participate in any campaign activity for or against political candidates.
Those four lines are the IRS's own summary (exemption requirements). Everything else — bylaws, board size, state registration — sits on top of them and varies by state.

Are all nonprofits 501(c)(3)?
No. “Nonprofit” is a state-law form; “501(c)(3)” is a federal tax status. An organization can be incorporated as a nonprofit and be exempt under a different paragraph, or not be exempt at all.

Exemption is also not the same as being free of every tax: state sales and property tax treatment is set by state law, and unrelated business income is reported on Form 990-T (IRS).

How do you check a 501(c)(3)'s status?
Use IRS Tax Exempt Organization Search, which shows whether an organization is currently recognised, whether contributions are deductible, and whether exemption was automatically revoked for failing to file for three consecutive years (IRS). Public charity or private foundation?
Within 501(c)(3) the IRS draws a second line. Private foundations are typically funded by one source and file Form 990-PF every year regardless of size; public charities draw support more broadly and file Form 990, 990-EZ or 990-N by size (IRS). The distinction affects filing, excise taxes and the rules on grantmaking.
